PHOENIX (AP) — Alyssa Thomas had 23 points, nine rebounds and nine assists, DeWanna Bonner added 19 points off the bench and the Phoenix Mercury won their fifth straight game with an 85-79 victory over the Indiana Fever on Tuesday night.

Phoenix (26-14), which had already clinched a playoff spot, moved into a second-place tie with Las Vegas (26-14) and Atlanta (26-14). The Mercury close the regular season against Washington, Connecticut, Los Angeles and Dallas.

Kelsey Mitchell had 29 points and five 3-pointers for Indiana (21-20). Lexie Hull added 18 points and Aliyah Boston had 11 points, eight rebounds and seven assists. Caitlin Clark missed her 19th straight game due to a right groin injury.

Satou Sabally added 13 points, Kahleah Copper scored 11 and Sami Whitcomb had 10 points and seven assists for Phoenix. Natasha Mack grabbed 10 rebounds. Bonner was 6 of 11 from the field against the team she played nine games for earlier this season.

Phoenix led 54-39 at halftime after closing on a 10-0 run, capped by Monique Akoa Makani's 3-pointer with 2.2. seconds left.

VALKYRIES 66, LIBERTY 58

SAN FRANCISCO (AP) — Temi Fagbenle scored 16 points and Golden State beat New York for their fourth straight win to close in on becoming the first expansion team to earn a playoff berth in an inaugural season.

The Valkyries dropped their magic number to clinch a top-eight playoff spot to two, with any combination of victories by Golden State and losses for the Los Angeles Sparks doing it. LA was idle Tuesday and plays again Wednesday, so the Valkyries could have their first chance as soon as Thursday.

Despite the loss, New York clinched a playoff berth with Indiana's defeat by Phoenix on Tuesday night.

Breanna Stewart scored 19 points for the defending champion Liberty, playing without star Sabrina Ionescu for a third straight game because of a left toe injury — this time for her return home to the Bay Area.

New York's Natasha Cloud also scored 19 points, including the initial nine for her team before Emma Meesseman's basket at the 3:42 mark of the opening quarter.

PHOENIX (AP) — Ketel Marte hit a three-run homer that snapped a seventh-inning tie and the Arizona Diamondbacks ended the Texas Rangers' six-game win streak with a 5-3 victory Tuesday night.

Jorge Barrosa and Jordan Lawlar singled off Hoby Milner (2-4) to begin the seventh. Marte sent a 414-foot drive to left-center for his 25th homer this season and a 5-2 lead.

Marte has gone deep in four straight games against the Rangers.

Texas (72-68) remained 1 1/2 games back of Seattle for the final American League wild card.

Nabil Crismatt pitched 6 1/3 innings in his fourth career start and allowed two runs on seven hits. Jalen Beeks (5-1) got the final two outs in the seventh for the win, and rookie Taylor Rashi allowed a run in two innings for his second multi-inning save in two major league appearances.

Michael Helman led off the Texas third with his first triple before scoring on Wyatt Langford's sacrifice fly for a 1-0 lead. Cody Freeman reached on a two-out infield single in the fourth and scored from first on Alejandro Osuna's bloop single to center to make it 2-0.

Rangers starter Jacob Latz cruised along until issuing walks to Corbin Carroll and Gabriel Moreno with one out in the sixth. Luis Curvelo gave up an RBI single to Blaze Alexander and a sacrifice fly by Ildemaro Vargas that tied it at 2.

Latz, who replaced injured Nathan Eovaldi in the rotation, was charged with two runs and five hits in 5 1/3 innings.

HOUSTON (AP) — Houston starter Framber Valdez said he apologized to catcher César Salazar after hitting him in the chest with a pitch Tuesday night, but he insisted that he didn't hit his teammate on purpose.

Valdez gave up a grand slam to Trent Grisham in the fifth inning of the 7-1 loss to the New York Yankees. On the next pitch, Valdez hit Salazar in the chest.

"What happened with us, we just got crossed up," Valdez said in Spanish through a translator. "I called for that pitch, I threw it and we got crossed up. We went down to the dugout and I excused myself with him and I said sorry to him and I take full responsibility for that."

Valdez was then asked directly if he did it on purpose.

"No," he said. "It was not intentional."

Valdez and Salazar were talking when reporters entered the clubhouse after the game and Valdez said they had sorted things out.

"We were able to talk through it," he said. "We spoke after the game… at his locker and everything's good between us. It's just stuff that happens in baseball. But yeah, we talked through it and we're good."

Salazar was asked about what happened on the pitch where he was hit.

"The stadium was loud," he said. "I thought I pressed the button, but I pressed the wrong button. I was expecting another pitch, but it wasn't it."

Salazar said Valdez didn't hit him on purpose.

"No, me and Framber we actually have a really good relationship," he said.

CINCINNATI (AP) — George Springer went 3 for 4 with two home runs and three RBIs, Bo Bichette hit a three-run homer, and the Toronto Blue Jays held on for a 12-9 victory over the Cincinnati Reds on Tuesday night.

The Blue Jays have 23 blown saves this season including Monday's 5-4 loss in the series opener, but Jeff Hoffman allowed one hit in the ninth for his 30th save.

Louis Varland (4-3) allowed one hit in 1 2/3 innings of relief.

Reds' scheduled starter Nick Lodolo was scratched due to illness, so Scott Barlow (6-3) was called upon to make his first career start. Things didn't go well for the 32-year-old right-hander.

Springer led off with his 25th homer of the season. Barlow then walked three straight batters to load the bases and Alejandro Kirk's bases-clearing double made the score 4-0.

Brent Suter replaced Barlow in the second inning and didn't fare any better. Bichette's three-run homer, his 18th of the season, made the score 8-1.

Springer's second home run, a two-run shot off Suter, made the score 10-6 in the fourth. It was his 29th multihomer game, second this season.

Daulton Varsho's solo homer, his second in as many nights, came off Connor Phillips in the seventh to make the score 11-8.

TJ Friedl's solo homer off Seranthony Domínguez in the eighth made the score 11-9.

After a throwing error by Blue Jays' third baseman Isiah Kiner-Falefa prevented the final out in the third, Austin Hays' three-run homer into the second deck of the left field bleachers cut the Reds' deficit to 8-6.

Springer now has 62 career leadoff homers, including a franchise-best 23 for the Blue Jays. He ranks second in major league history behind Rickey Henderson who had 81 leadoff homers.

PITTSBURGH (AP) — Tommy Pham and Jared Triolo each drove in two runs, and the Pirates spoiled a big night by Shohei Ohtani to beat the Los Angeles Dodgers 9-7 on Tuesday night.

Ohtani hit his 100th home run with the Los Angeles Dodgers and had a pair of doubles.

Ohtani hit a solo shot off top prospect Bubba Chandler (2-0) for his 46th homer this season. Playing his 294th game with the Dodgers, he became the fastest to reach 100 home runs in team history ahead of Gary Sheffield (399).

Teoscar Hernández then hit a two-out RBI single and Andy Pages led off the next inning with his 24th homer, tying it 4-all.

Henry Davis put the Pirates back ahead on an RBI single off Edgardo Henriquez (0-1) in the sixth. Triolo added a two-out, two-run double.

Chandler gave up three runs on six hits in four innings of relief. The 22-year-old has two wins and a save in his first three major-league appearances.

Dennis Santana walked Miguel Rojas and allowed Ohtani's second double to start the ninth before retiring the next three batters for his 12th save.

Clayton Kershaw yielded four runs, four hits and a pair of walks in the first inning. He recovered to last five innings, denying the Pirates of another hit while allowing two walks over the final four.

Triolo walked with two outs in the eighth and stole second. Nick Gonzales then sent a soft, looping ball into center where Pages came just short of making a sliding catch. Triolo scored an insurance run, putting the Pirates up three with the top of the Dodgers order coming in the ninth.

Attorney General Pam Bondi and the Justice Department are facing blowback over their effort to block a lawsuit from members of the far-right Proud Boys, who are seeking financial reimbursement for their criminal cases and imprisonment for offenses stemming from the Jan. 6, 2021 Capitol riot.

The Proud Boys Jan. 6 rioters, who met in a social media "X spaces" gathering last month, are calling for Bondi's resignation, after the Justice Department filed a motion in federal court in Florida last week, asking a judge to dismiss a civil lawsuit filed by Enrique Tarrio, Zachary Rehl, Domenic Pezzola and other Proud Boys. All the men were imprisoned for their roles in the riot before President Trump pardoned them on the day he was inaugurated for his second term.

The Proud Boys' lawsuit seeks more than $100 million in damages and alleges the men suffered "A parade of horribles: egregious and systemic abuse of the legal system and the United States Constitution to punish and oppress political allies of President Trump, by any and all means necessary, legal, or illegal."

"Through the use of evidence tampering, witness intimidation, violations of attorney-client privilege, and placing spies to report on trial strategy, the government got its fondest wish of imprisoning the J6 Defendants," the lawsuit claims.

In a filing on Aug. 25, the Justice Department responded that the Jan. 6 defendants had not yet exhausted administrative remedies before they filed suit and also argued the U.S. enjoys sovereign immunity from such claims.

An attorney for Jan. 6 defendants sent a statement to CBS News, saying, "Motions to dismiss are a common reaction to a civil complaint, and we anticipated that the attorney the government assigned to the case would make such a motion. We are confident that the Court will see that the Federal government's outrageous treatment of my clients justifies allowing the suit to continue. "

In their publicly posted X spaces meeting video, Jan. 6 defendants and supporters blistered the Justice Department for opposing the Proud Boys' civil challenge.

Isaac Thomas, a pardoned Jan. 6 defendant from Michigan who participated in the meeting, said, "Unfortunately, Pam Bondi's DOJ seems to be advocating for the same things that the Biden regime was advocating for. A long time ago, I joined the call of Trump supporters saying that Pam Bondi needs to step down." Thomas said the Jan. 6 defendants "have been dumped out."

Mark McCloskey, an attorney who said he is seeking financial payments for Capitol riot defendants, said in the video he was "very disappointed" in the Justice Department's challenge to the Proud Boys lawsuit. He said if the Justice Department opposes other legal challenges seeking restitution or financial awards for Jan. 6 defendants, "It's going to make our lives very difficult."

He predicted more legal challenges would be coming, as some of the more than 1,500 Jan. 6 defendants pursue financial compensation, and he referenced "hundreds" of people who could be impacted.

The Justice Department did not have an immediate comment to the recent Jan. 6 defendants' online meeting.

The civil lawsuit filed by Proud Boys members also alleges malicious prosecution and violation of Fourth Amendment protections, claims that the Justice Department rebutted in its response to the suit.

In their Aug. 25 filing, the Justice Department argued the Proud Boys defendants failed to sufficiently demonstrate the case was "malicious" and that their constitutional rights had been violated. The 17-page filing from the department did not address whether the men had been rightfully or wrongfully convicted by a jury.

The Proud Boys also allege harsh conditions in jail in their lawsuit, and it referenced the language used in President Trump's pardon order for Capitol insurrection defendants, which said, "This proclamation ends a grave national injustice that has been perpetrated upon the American people over the last four years and is a process of national reconciliation."

An attorney who filed the suit did not immediately respond to requests for comment from CBS News.

A Justice Department attorney who filed the motion to dismiss the Jan. 6 defendants' lawsuit has been harshly criticized by name on social media. In one instance, the attorney was referred to as being one of the "swamp rats." News of the Justice Department court filing also triggered a wave of critical comments about the department in a weekend social media post by a media outlet aligned with Trump supporter Mike Lindell, who made baseless claims about the 2020 election.
